The Steps in a Georgia Divorce Case: From Filing to Final Decree

Every divorce case is different, but most Georgia divorces move through a similar series of stages.

Some cases resolve quickly because the spouses agree on everything. Others involve disagreements over property, custody, child support, or other issues and require additional steps before the case can be finalized.

Step 1: One Spouse Files a Complaint for Divorce

A divorce case officially begins when one spouse files a Complaint for Divorce in Superior Court. The person who files the case is generally called the Plaintiff or Petitioner, while the other spouse is the Defendant or Respondent. The Complaint identifies the marriage and the legal basis for requesting a divorce and may also ask the court to address issues such as:

Division of marital property and debts
Child custody
Parenting time
Child support
Use or possession of the marital home
Attorney’s fees
Other financial or family-related issues

Georgia divorces are handled in Superior Court. Georgia also has residency and venue requirements that determine whether a divorce can be filed in Georgia and which county is appropriate.

Step 2: The Other Spouse Is Served

After the case is filed, the other spouse must generally receive legal notice of the divorce action. This is known as service of process. Depending on the circumstances, service may occur through a sheriff, private process server, or another legally permitted method. A spouse may also voluntarily sign an Acknowledgment of Service, confirming that the divorce papers were received without requiring formal personal service.

Step 3: The Responding Spouse Files an Answer

The spouse who receives the divorce complaint generally has an opportunity to file an Answer. An Answer allows that spouse to admit, deny, or respond to the allegations made in the Complaint. The responding spouse may also raise his or her own requests regarding issues such as:

Property division
Custody
Parenting time
Child support
Alimony
Attorney’s fees

In some cases, the responding spouse also files a Counterclaim for Divorce, asking the court to grant a divorce and requesting specific relief. Once both sides have filed their initial pleadings, the issues that are actually disputed often become clearer.

From Here, the Case Can Take Two Different Paths

At this stage, one of the most important questions becomes:

Do the spouses agree on all of the issues necessary to resolve the divorce?

If the answer is yes, the case may proceed as an uncontested divorce.

If disagreements remain, the case proceeds as a contested divorce until those issues are resolved through negotiation, mediation, court rulings, or trial.

Step 4A: If the Divorce Is Uncontested

A divorce is generally considered uncontested when the spouses have reached agreement on all issues that must be resolved. Depending on the case, that agreement may include:

Division of property
Division of debts
Child custody
Parenting time
Child support
Health insurance
Other financial responsibilities

The agreement is typically put into written documents for submission to the court. Georgia law provides that a divorce based on the marriage being irretrievably broken cannot be granted until at least 30 days have passed from service on the responding spouse. That does not mean every divorce will be completed in 30 days. Court procedures and individual circumstances can affect when the case is actually finalized.

Step 4B: If the Divorce Is Contested

If the spouses cannot agree on one or more issues, the case remains contested. A contested divorce may involve disagreement about:

Who should have primary physical custody
Parenting schedules

The value or division of a home
Retirement accounts

Bank or investment accounts
Credit card or other marital debt
Separate versus marital property

The purpose of the remaining divorce process is ultimately to resolve those disputed issues. That does not necessarily mean the case will go to trial. Many contested divorce cases settle before a final hearing.

Step 5: Temporary Orders May Be Needed

A divorce can remain pending while spouses still need rules governing their day-to-day lives. When necessary, a party may ask the court to enter a temporary order. A temporary order may address issues such as:

Who remains in the marital residence
Temporary custody
Parenting schedules
Temporary child support
Responsibility for household expenses
Use of vehicles or other property
Restrictions involving marital assets

A temporary order generally governs the parties while the divorce case is pending. It is not necessarily the same result that will appear in the final divorce decree. Not every divorce requires a temporary hearing.

Step 6: Financial Information and Discovery May Be Exchanged

When spouses disagree about financial issues, custody, or other important facts, they may need additional information before the case can be resolved. This stage is commonly called discovery.

Discovery is the formal process parties use to obtain information relevant to the case. It may include:

Interrogatories

Written questions that another party must answer.

Requests for Production of Documents

Requests for records such as:

Bank statements
Tax returns
Pay records

Text messages, emails, or other relevant communications

Step 7: Negotiations Continue

Settlement discussions can occur throughout a divorce case — not just at the beginning or end. Attorneys may exchange proposals regarding:

Sometimes the spouses gradually resolve individual issues until only one or two disagreements remain. If they eventually reach agreement on every issue, the case can usually move toward an uncontested resolution rather than trial.

Step 8: The Case May Go to Mediation

Many Georgia divorce cases use mediation before trial. In mediation, a neutral mediator helps the spouses and their attorneys attempt to reach a voluntary agreement. The mediator does not decide the case. The court may also hold a pretrial conference or require specific documents before the final hearing. Procedures vary between Georgia counties and individual judges.

Step 10: Final Hearing or Trial
